About the terms and conditions
- These terms apply to all services provided by us, Bali Nanny, ("us", "we" or "Bali Nanny") to you, the customer or client ("you") until expressly excluded in writing.
- These terms and conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except in writing signed by an owner of Bali Nanny.
- These terms and conditions will prevail over any terms and conditions used by you or contained or set out or referred to in any documents sent by you to us. By entering into a contract with us, you agree irrevocably to waive the application of any such terms and conditions.
Provision of nanny
- If we provide a nanny to you, you agree to accept these terms and conditions and to pay our fees as set out at our web site.
- If you engage a nanny through us, then you agree to pay our charges as provided in our booking confirmation. If a booking confirmation has not been completed, you agree to pay our standard charges as set out on our website.
- You must not contact any nanny provided by us to engage them directly. If you do so you will be liable for our charges as set out below.
- Our nanny details are strictly confidential and you must not pass on details to any other person. If you do pass on details of a nanny introduced by us to another family or person, you agree to pay a penalty fee of 1,000,000R.
- We reserve the right to substitute a nanny for one previously agreed with you if the first nanny is unavailable for reasons beyond our control.
Price and Payment
- Hourly rates are published on this web site on the Costs page.
- We charge in increments of 1 hour only and will round up part hours worked.
- We will provide all quotes in Indonesian Rupiah. However, we charge in Australia dollars
using the exchange applicable at the time of invoicing. Note, we will round up to the nearest Australian dollar to cover conversion and processing costs.
- The cost of your booking will be the relevant hourly rate over the time of your booking plus any applicable transport costs.
- Before accepting and confirming a casual booking, we will need to be paid
a deposit towards the total fees payable by you for our services.
- The deposit equates to around 20% of the total booking and is non-refundable unless
the value of the booking is up to AUD$50, where the deposit will constitute 100% of the
booking cost.
- We will calculate the deposit and forward you a PayPal invoice by email.
- Your booking is not confirmed until payment of your deposit is finalised.
- We will invoice for the remaining amount within one week before your departure date.
We require finalisation of your invoice before we provide a nanny to you except at our discretion in exceptional circumstances.
- If you make a booking within one week of your departure, payment in full will be required.
- The total deposit calculated in the PayPal invoice is valid for 30 days from the date of issue. In the case of a price change, we reserve the right to cancel any invoices remaining unpaid after this time period.
- Ongoing weekly bookings are paid for in full, one week in advance.
- If the number of hours worked by the nanny is greater than that paid for, we will invoice for the additional amounts at the end of the engagement, except in the case of weekly ongoing employment where we will invoice in the next week's invoice.
- We do not issue refunds where the number of hours worked by the nanny is less than that paid for. However, at our discretion, we may rearrange the nanny's work times to provide you with access to the additional paid for hours on a different day.
- If you believe the nanny has breached the terms of the agreement after payment, you will be responsible for recovering any fees from the nanny, as we will not accept this responsibility.
Working hours
- A nanny will work for a minimum time period of 4 hours in each engagement. If she is required to work less than this time period, payment will be for the full 4 hours.
- A nanny will work for a maximum of 12 hours in each engagement. The payment will include 8 hours at the normal rate and 4 hours at the overtime rate.
- Unless specified otherwise in writing, a nanny will have a 30 minute paid break for each 4 hourly period.
- Unless specified otherwise, a live-in nanny will provide childcare services for up to 72 hours in a 7 day week.
- Unless specified otherwise, a live-in nanny will be entitled to 1 day off per 7 days i.e., she will work for 6 days and then have 1 day off.
Refreshments
- If the nanny works 6 or more hours, she must be provided with a meal at normal meal times. A simple meal such as nasi goreng or cap cay is suitable.
- A nanny must be provided with water or other suitable liquid refreshments throughout her period of engagement.
Nature of Our Services
- You are responsible for providing us with accurate information about your requirements before you engage a nanny.
- One nanny can look after a maximum of 2 children at any one time.
- Any nanny provided to you will be a self-employed contractor who will provide nanny services to you during your holiday.
Our Liability
- We will not be liable to you for any indirect, special or consequential loss you may suffer arising out of or in connection with the provision of any services pursuant to these terms. Indirect, special or inconsequential loss means losses such as loss of profit, lost opportunity or lost reputation. Our liability to you in relation to any financial losses suffered by you shall not exceed the charges payable by you for our services.
- We agree to sight a current (up to one year old) SKKB (police clearance) form for each nanny.
- We will also check 2 references supplied by the nanny. Where a nanny has relevant professional or other qualifications, we will seek to obtain copies of the relevant certificates.
- You agree that provided we take these steps we are not obliged to carry out any further background checks on nannies introduced to you.
- We cannot guarantee the suitability of any nanny supplied to you and we will not be liable for the acts or omissions of the nanny, who will be directly engaged by you, you are therefore advised to make sure you are satisfied with the nanny and inform us if this is not the case.
- Please note that if the nanny abandons their duties during your holiday we will not be responsible for any losses you suffer.
- We will try to locate a replacement nanny but cannot guarantee that a suitable replacement will be available. In such circumstances the deposit will not be repayable to you unless agreed in writing.
- Nothing in these terms will exclude our liability for death or personal injury arising as a result of our negligence.
Termination
- Once we have confirmed a booking, you will be entitled to terminate the engagement up to the date of your departure. However if you do terminate the engagement you agree to forfeit the deposit paid to us.
- If, prior to your departure, we are unable to provide the nanny you have requested due to circumstances beyond our control, for instance if the nanny cancels the engagement, then we will endeavour to find an alternative suitable to you. If we are unable to provide a suitable alternative nanny then we will reimburse the deposit paid by you.
General
- This agreement is to be governed by Australian Law in every particular including formation and interpretation and shall deemed to have been made in Australia.
- Any proceedings arising out of or in connection with this agreement must be brought in the courts of Australia.
- Failure by us at any time to enforce any one or more of the terms and conditions set out above will not prevent us from taking steps to enforce at a later date any right you may have under these terms.
- Our nannies are independent contractors and no employment relationship shall be created by any provision of services by us.
- We will be entitled to subcontract any of our rights or duties under these terms.
- You are not entitled to withhold payment of any sum otherwise payable to us by reason of any claims set off or for damages.
